Acceptance of Terms
By accessing or using the Shftty platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform. These terms apply to all users, including staffing agencies, administrators, and contractors.
Service Description
Shftty is a healthcare staffing scheduling platform that connects registry agencies with qualified contractors including CNAs, LVNs, and RNs for placement at skilled nursing facilities and other healthcare settings. We provide shift posting, contractor matching, notification, and scheduling tools. We do not employ contractors directly and are not responsible for the quality of care provided by contractors placed through our platform.
User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when registering, and to keep your professional credentials and certifications up to date. Users must comply with all applicable federal, state, and local laws, including healthcare licensing requirements and HIPAA regulations.
Limitation of Liability
To the fullest extent permitted by law, Shftty shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability to you for any claim arising from or related to these terms or the platform shall not exceed the fees paid by you in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of these limitations may not apply to you.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Delaware. You consent to personal jurisdiction in such courts for the purpose of resolving any such dispute.
